Terms of service

The service
Adaven is a personal health record provided by Avalen LLC. It gathers health information from sources you choose into one record that you control. By creating a record you agree to these terms and to the privacy policy.
Your account
You sign in with your Google account and are responsible for keeping that account secure. One person, one record. Adaven is for adults.
Your information is yours
You own the information in your record. Avalen LLC claims no rights over it and uses it only to provide the service to you, as described in the privacy policy. You can export it and delete it at any time.
Not medical advice
Adaven organises your records. It is not a doctor, does not diagnose, and does not give medical advice. Anything it shows you, including trends, flags or risk estimates, is information to take to a clinician, not a substitute for one. If you think you have a medical emergency, call your local emergency number.
Providers and devices
When you connect a provider or a device, you confirm that the account is yours and that you are allowed to share its records with Adaven. Adaven reads from those sources only as you allow and never changes anything at the source.
Acceptable use
Do not use Adaven to hold records of a person who has not agreed, to probe or disrupt the service, or to break any law. We may close an account that does.
Accuracy of information
Adaven shows what your sources sent and what you entered. We check units and remove duplicates, but we do not verify that a provider’s result, a device’s reading or a value read from a document is correct. Check anything that matters with the source and with a clinician.
Availability and warranties
Adaven is early and is being built for a small number of people first. We work to keep it available and your record intact, and we keep backups, but the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not promise it will be free of interruptions, errors or loss.
Limitation of liability
To the fullest extent the law allows, Avalen LLC and the people who work on Adaven are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcome, or decision made in reliance on the service. Our total liability for any claim is limited to the amount you paid for the service in the twelve months before the claim, which today is nothing. Some places do not allow these limits; there, they apply as far as permitted.
Indemnity
If your misuse of Adaven, or information you upload about another person without their permission, leads to a claim against Avalen LLC, you agree to cover the resulting costs.
Ending the service
You can delete your record at any time, and that is final. If Avalen LLC ever has to end the service, you will be given notice and the chance to export your record first.
Changes to these terms
We may update these terms. The current version is always published here with its date, and material changes are announced to signed-in people before they take effect. Continued use after a change means you accept it.
Law and disputes
These terms are governed by the laws of the State of Delaware, United States, where Avalen LLC is organised, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Delaware, and both sides agree to that venue. If any part of these terms is found unenforceable, the rest still applies.
